These Terms of Service ("Terms") govern your access to and use of the website at condoinspectpro.com, the application at erp.condoinspectpro.com, and any related software or services (collectively, the "Service") operated by Condo Inspect Pro ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
You may use the Service only if you are:
The Service is intended exclusively for Ontario condominium corporations. We do not warrant the Service for use outside Ontario or for non-condominium buildings.

We reserve the right to suspend or terminate your access at any time for breach of these Terms.
We provide a software platform that generates a building-specific Emergency Response Plan from a Fire Safety Plan you upload and information you provide. The output is a software-generated document. The Service uses third-party AI processing through Anthropic Claude to extract data from uploaded documents.

You are responsible for reviewing all extracted data, confirming all information, and engaging qualified professionals to review the output before relying on it for compliance representation.
The current fee for the Service is CAD 24.99 per Emergency Response Plan generation, payable in advance through Stripe. Discount codes may be available from time to time. Prices are subject to change with notice posted on condoinspectpro.com.
All fees are processed by Stripe. We do not store credit card information.
Our Refund Policy is set out separately at condoinspectpro.com/refunds and is incorporated into these Terms by reference.
The Service, including its software, design, brand, and documentation, is owned by Condo Inspect Pro. We grant you a limited, non-exclusive, non-transferable license to use the Service to generate Emergency Response Plans for the corporation named in your upload.
The output of the Service (the generated Emergency Response Plan) is licensed to you for use in connection with the named corporation only. You may not resell, redistribute, or sublicense the output. The corporation may distribute the output to its board, residents, property manager, fire prevention officer, insurer, and condo counsel for the purposes contemplated by the Service.
The Fire Safety Plan you upload remains the property of the corporation or the consultant who prepared it. We do not claim ownership of uploaded content.
Our handling of personal information is governed by our Privacy Policy at condoinspectpro.com/privacy, which is incorporated into these Terms by reference.
The Service uses Anthropic Claude, an AI service, to extract data from uploaded Fire Safety Plans. AI processing involves transmitting the document text or images to Anthropic for processing. Anthropic does not retain or train on data submitted through the Anthropic API per their terms. AI extraction may produce errors and you are responsible for reviewing all output.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
To the fullest extent permitted by applicable law, our total cumulative liability arising out of or in connection with these Terms or the Service, however arising and regardless of the form of action, is limited to the amount paid by you in the twelve months preceding the claim.
We are not liable for any indirect, consequential, special, incidental, exemplary, or punitive damages, including but not limited to loss of business, loss of revenue, loss of data, business interruption, third-party claims (including claims by residents, owners, visitors, or emergency responders), or regulatory fines or penalties, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Condo Inspect Pro, its directors, officers, employees, and contractors from any third-party claims, demands, losses, damages, costs, or expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your distribution of any output, your breach of these Terms, or your violation of any applicable law, except to the extent caused by our gross negligence or willful misconduct.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising out of or in connection with these Terms or the Service will be resolved by binding arbitration in Toronto, Ontario, under the rules of the ADR Institute of Canada. Each party bears its own legal costs.
You may not bring any claim more than one year after the cause of action arises.
We may modify these Terms at any time. We will provide at least 30 days notice of material changes by email to the address you provided at the time of your last purchase or by posting a notice on condoinspectpro.com. Continued use of the Service after the effective date of the modified Terms constitutes acceptance.
We may suspend or terminate your access at any time, with or without cause, with or without notice. Sections 6, 7, 8, 9, 10, 11, and 13 of these Terms survive termination.
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Condo Inspect Pro regarding the Service.
